Settlement Agreements are sometimes entered into during marital litigation. Settlement Agreement interpretation is based in contract law. In the recent South Carolina Supreme Court opinion of Gafney v. Gafney, the decision reflected the importance of the language used in Settlement Agreements. The Court highlighted that when an agreement is clear, the court only has to look at the four corners of the agreement to determine the parties’ intention.
